Seller:
Item must be posted for $5.00 or more
50%* of proceeds will go to American Heart
Small Items can be displayed at the Freeman Office. Sale ends December 15, 2008. It will be sellers responsibility to pick up items or they will be donated to a local charity.
Pictures of items are to be submitted by e-mail to George Eaton who will post to the auction web site george.eaton@freemanco.com
Item description must contain (price or bid option) (condition of item) (location) (telephone number of seller)
Seller is responsible to submit donation portion of sale to Joelle Graf at Freeman (504-731-1239). Any non-Freeman seller, MUST have a Freeman Employee to sponsor transaction.
We will not accept clothes on the website. All articles are subject to approval before posting.

Buyer:
No returns, no refunds

Bids will be logged based on the date and time on the e-mail submitted
Payment Terms:
Payment must be made at time of pick up by Cash, *Check, or **Credit Card (over $25.00) .
* If you pay by check, you will have to make out 2 checks, 50% each, one to American Heart and one to cash.
** If you want to pay by Credit Card you must contact Kim Richardson at Freeman (504)-731-1582 for processing. Freeman will notify the Seller and you can pick up your item. Freeman will then pay the Seller their 50% of the transaction and will give the American Heart Association the other 50%.
NOTE: On "High Ticket Items" (over $500.00) the 50/50 rule will be waived, however a minimum donation of $100 will be required.
Disclaimer Policy:
Liability
You will not hold Your Virtual Garage Sale responsible for other users' content, actions or inactions, or items they list. You acknowledge that we are not a traditional auctioneer. Instead, the sites are a venue to allow anyone to offer, sell, and buy just about anything, at anytime, from anywhere, in a variety of pricing formats and venues, such as stores, fixed price formats and auction-style formats. We are not involved in the actual transaction between buyers and sellers. We have no control over and do not guarantee the quality, safety or legality of items advertised, the truth or accuracy of users’ content or listings, the ability of sellers to sell items, the ability of buyers to pay for items, or that a buyer or seller will actually complete a transaction.
We do not transfer legal ownership of items from the seller to the buyer. Unless the buyer and the seller agree otherwise, the buyer will become the item's lawful owner upon physical receipt of the item from the seller. Further, we cannot guarantee continuous or secure access to our services, and operation of the sites may be interfered with by numerous factors outside of our control. Accordingly, to the extent legally permitted, we exclude all implied warranties, terms and conditions. We are not liable for any loss of money, goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of our sites and services. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.
Regardless of the previous paragraph, if we are found to be liable, our liability to you or to any third party is limited to the greater of (a) the total fees you paid to us in the 12 months prior to the action giving rise to the liability, and (b) $100.
Release
If you have a dispute with one or more users, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.
